By accessing this website you agree to these terms and conditions. If you do not agree to them, you cannot use and access this website. The Wild Swans website is provided solely for your personal, non-commercial use. You cannot use this website for any commercial purpose.

ACCEPTANCE OF YOUR ORDER

The display of any item on our website is not an offer to sell and Wild Swans shall be under no obligation to supply the products ordered through this website. When you place an order on the website you make an offer to us to buy a product. We will acknowledge your order as soon as possible but will be under no obligation to supply the products ordered unless we have the products in stock and they are available at the prices specified.
If items that you ordered are out of stock, subject to a delay or the price is higher than shown on your order, we will try to contact you at the email address you provided when placing your order. If we are unable to contact you or receive no response to our email, we will continue to process the remaining items on your order. We undertake that we will not supply a substitute product without your express authority.

DELIVERY

We will aim to deliver your chosen items to the place and person of your choice, in perfect condition and in the shortest possible time. UK and overseas orders will be shipped by Post or DHL for a speedy delivery. Minimum delivery charge is £4.50 per UK delivery and £20 for overseas delivery. We insure each purchase during the time it is in transit until it is delivered to you. If you wish to track your parcel, then please email us and we will either track your order for you or email you a tracking number which can be used on the post or DHL website.
As a rule, we require 3-4 working days from receipt of your order. Please note that particularly during periods when an increased number of sales are running, your order could take a little longer. We will do our best to inform you as soon as possible of any unexpected delay in delivery.
Please be aware customers are responsible for payment of any local customs duties and taxes.

RETURNS / EXCHANGE POLICY

Wild Swans guarantee to refund or exchange any item you are not completely happy with when you return it to us in saleable condition within 14 days of receipt.

Before you return something you must notify us within 48 hours of receiving an item and obtain a Return Authorization reference number by emailing us at info@wild-swans.com. Please include your original receipt in the returned parcel. You must write your Return Authorization return number on the receipt. Returned items that are not accompanied by an official reference number and receipt will not be accepted.

Wild Swans will only exchange an item for the same item in a different size, subject to availability, if a different garment is desired you must place this as a new order. Returns received after the 14 days time frame are accepted at the discretion of Wild Swans and can only be refunded with a "Store credit note" which can be used online or in any of the Wild Swans boutiques.

Jewellery and accessories purchased through our website must be shipped back to us for return or exchange within 3 working days of receiving the item. In the interests of hygiene we are unable to accept returns or exchanges on pierced earrings. Please be aware that shoes must be returned in their original designer box. Shoes returned without their original designer boxes will not be accepted.

Please send all returns to Wild Swans, 54 Cross Street, Islington, London N1 2BA, for the attention of the Manager. We will gladly accept returns of any new, unwashed, unworn and unused product with all the original packaging and garment tags retained and still attached. We do not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser.

If you wish to receive a refund we will re-credit the original purchasers credit card for the sum paid less any taxes and duties and less the postal costs.

It is advisable to send returned items by registered post/DHL and keep your proof of postage certificate, as we regret we cannot be responsible for goods lost or damaged in transit.
Please note that postal costs for returned goods are the customers responsibility and will be reimbursed by us only in the case of damaged, faulty or incorrectly supplied goods.

RETURNS POLICY FOR SALE ITEMS

Same as above except that we request that all sale items are returned within 7 days of the date you receive your Return authorization reference number.

PAYMENT

Payment for Goods ordered online must be made via our website using Visa, Master card or Maestro cards. To make sure you have the highest level of security, your payment details are automatically encrypted when you enter them. You may also place your order through the telephone to one of our Boutiques.
The credit/debit card that is being used must belong to you. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorise payment, we will not be liable for any delay or non-delivery of your order. We also reserve the right to cancel your order. We may request that shipping be to the credit card billing address only.

The price payable for the Products shall be as shown on the Website. Prices advertised on the Website include VAT but excludes delivery charges. Delivery charges are shown separately when ordering and must also be paid in advance.

By submitting an order to us through the Wild Swans website you represent and warrant that the payment details provided on your order are all valid and correct and that when your order is accepted and processed by us, payment will be made in full.

If the billing details for your order are the same as your delivery address details, by placing an order on the website you are confirming that you are the person referred to in the delivery address details. Otherwise, by placing an order, you are confirming that you are the person referred to in the billing details.

THE WEBSITE

As a result of the unpredictability and unreliability of technology and the online environment, Wild Swans does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components .Accessing the website is entirely at your own risk. Wild Swans are not responsible to you if we are unable to provide our internet services for any reason beyond our control.

This site and the materials and products in this site are provided "as is" and without warranties of any kind, whether express or implied. Wild Swans reserve the right the right to amend any errors, make changes to our website, and withdraw any part of our site or to update product information at any time if we consider it necessary.

OUR LIABILITY

If Wild Swans do not deliver or if the Products We deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, our only obligation will be, at our option to:

1. make good any shortage or non-delivery or incorrect delivery; or
2. replace or repair any Products that are damaged or defective; or
3. refund to you the amount paid by you for the Products in question.

We shall have no liability to you for any consequential, special or indirect losses including without limit loss of revenue, profits, contracts, business or anticipated savings damage to or loss of goodwill, reputation or data.

Without prejudice to the foregoing, our total aggregate liability to you under and/or arising in relation to this contract shall not exceed the amount paid by you for the Products.

Nothing in this contract shall exclude or limit our liability for death or personal injury due to our negligence or any liability which is due to our fraud or any other liability which Wild Swans are not permitted to exclude or limit as a matter of law.
Nothing in this contract shall exclude or limit your statutory rights.

INTELLECTUAL PROPERTY RIGHTS

All and any Intellectual Property Rights in connection with the Products shall be owned by Wild Swans absolutely.

INDEMNITY

You agree to indemnify, defend and hold harmless Wild Swans, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your breach of these terms and conditions, your infringement of any intellectual property right or any other right of any person or entity, or your breach of any duty of confidence or privacy, or any defamatory statements made by you in any form.

JURISDICTION

This website is controlled and operated by Blissful Services Limited trading as Wild Swans in the UK. These terms and conditions and all matters connected with any order that you place in our website are governed and construed in accordance with English Law and it is agreed that the English courts shall have exclusive jurisdiction in the event of a dispute.
